General information
Pursuant to section 27 of the General Act on Equal Treatment (Allgemeines Gleichbehandlungsgesetz – AGG), one of the tasks of the Federal Anti-Discrimination Agency at the Federal Ministry for Education, Family Affairs, Senior Citizens, Women and Youth involves counselling persons who feel they have been discriminated against under any of the grounds listed in section 1 of the AGG.
- In addition, the Federal Anti-Discrimination Agency is responsible for the following:
- informing the public about its work,
- providing information,
- carrying out specialist events,
- implementing measures to prevent discrimination
- and conducting scientific studies on these as well as submitting reports to the German Bundestag.
When personal data are processed in the context of these activities, this is carried out on the basis of the relevant legal provisions, above all the European General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (Bundesdatenschutzgesetz – BDSG).
Personal data refers to all information relating to a person who has either already been identified or who can be identified through this information. Identifiability may result either from combining available information or incorporating additional measures, for instance through attribution to a specific name identifier, identification number, location data, online identification data or through research in publicly accessible information pools such as databases, libraries or the internet. Persons under the age of 16 should not provide personal data without their parents’ or legal guardians’ consent.

Which data are processed when I visit this website?
Log files
Each time the online offering is accessed or a file is retrieved, the following data related to this process are temporarily stored in a log file for security reasons:
- Date and time of retrieval
- Details of request and destination address
- Name of retrieved file and amount of data transferred
- Report on whether retrieval was successful (HTTP Status Code)
The legal basis is Article 6 (1) letter e, subsection (2) of the GDPR in conjunction with section 5 of the Act on the Federal Office for Information Security (Gesetz über das Bundesamt für Sicherheit in der Informationstechnik – BSIG). To protect against attacks on its internet infrastructure, the Federal Anti-Discrimination Agency is obligated to store these data.
The user’s IP address is not stored in this context. Log data are retained for 30 days.

What data is collected when registering for the newsletter and/or ordering materials?
If you subscribe to email notifications from the Federal Anti-Discrimination Agency about news relating to the survey “Discrimination in Germany” (newsletter), the following personal data will be processed:
- Email address
The legal basis for processing is Art. 6 (1) (e), (2) GDPR in conjunction with § 27 AGG and § 3 BDSG (fulfillment of the task falling within the competence of the Federal Anti-Discrimination Agency). You can unsubscribe at any time. Your personal data will then be irrevocably deleted.
If you order free material, the personal data you enter in the order form will be transmitted to the Federal Anti-Discrimination Agency.
If the items in the “shopping cart” are to be ordered and delivered to your home, the following personal data will be processed for this purpose:
- Email address
- First and last name
- Company and department (optional)
- Address (street, house number, postal code)
For this purpose, the Federal Anti-Discrimination Agency transmits the data to IBRo Versandservice GmbH, Kastanienweg 1, 18184 Roggentin (contract processor for material dispatch).
The legal basis for the processing is Art. 6 (1) (e) and (2) GDPR in conjunction with Section 27 AGG and Section 3 BDSG (fulfillment of the task within the scope of responsibility) or Art. 6 (1) (b) GDPR (fulfillment of a contract between the customer and the Federal Anti-Discrimination Agency). The personal data will be deleted 90 days after the ordered items have been shipped or the contract has been fulfilled.
What data is processed if I participate in the “Discrimination in Germany” survey?
If you participate in the “Discrimination in Germany” online survey, additional personal data will be processed. At the very beginning of the survey, you are informed about data protection and the processing of personal data and asked for your consent.
Links to social networks
This website includes links to the Federal Anti-Discrimination Agency’s social network channels on Instagram, Facebook, LinkedIn and YouTube. The Federal Anti-Discrimination Agency expressly points out that using the Share function and visiting our social network channels means that personal data are transmitted to the respective social networks.
Those services store and process personal data for commercial purposes according to their data use policies. Data may be stored outside of the Member States of the European Union. The Federal Anti-Discrimination Agency has no control over collection and further use of data by the social networks. For instance, the Federal Anti-Discrimination Agency has no information on how much data are stored where or for how long, to what extent the networks carry out their deletion obligations, what evaluations and combinations are carried out with the data and to whom the data are passed on.
What rights do data subjects have?
Insofar as your personal data are processed by the Federal Anti-Discrimination Agency or a processor, you are a data subject within the meaning of the GDPR. In this regard, your rights in respect of the Federal Ministry for Education, Family Affairs, Senior Citizens, Women and Youth as controller within the meaning of the GDPR are as follows:
- Right of access (Article 15 of the GDPR)
- Right to rectification (Article 16 of the GDPR)
- Right to erasure (Article 17 of the GDPR)
- Right to restriction of processing (Article 18 of the GDPR)
- Right to data portability (Article 20 of the GDPR), applies only in the case of data processing based on consent
- Right to object (Article 21 of the GDPR), applies only if data processing is not carried out on the basis of consent
Where the processing of personal data is based on consent (Article 6 (1) letter a of the GDPR), data subjects may revoke that consent. The lawfulness of processing remains unaffected until such time as consent is withdrawn (Article 7 (3) of the GDPR).
Furthermore, data subjects have the right to lodge a complaint with a data protection supervisory authority under Article 77 of the GDPR. The supervisory authority responsible for the Federal Ministry for Education, Family Affairs, Senior Citizens, Women and Youth is the Federal Commissioner for Data Protection and Freedom of Information.
